WHAT MAKES THE BOOK DIIFERENT?
We use our own devised formal to teach and advise. The book is written in a way that compliments the way we teach. The information is categorised into what you need to know. Firstly the general rule of the legal postilion. This gives you the rule without any fuss. Second the case the rule comes from with a case name and full citation. Third the book tells you what the court held in the case. Lastly it shows you how the case should be applied.
THE FACT LAW SANDWICH METHOD
You may have encountered several ways or formulae while counseling a customer in a simulated situation. The IRAC and CELO methodologies are two examples. These are well recorded and may be read about. I never utilised them since I had a working approach in my thoughts. It wasn't until I began teaching that I discussed it. I refer to my strategy as the "Fact Law Sandwich." Let me clarify. If requested to advise a party on their legal rights, you should offer the following:
1. FACTS
2. GENERAL PRINCIPLE
3. LAW
4. APPLY TO FACTS
ADVISING USING THE FACT LAW SANDWICH
Under Fact, merely explain what you've been informed; hence, you can never be accused of ignoring facts. In General Principle, you just describe the applicable issue's general rule. You communicate as though you are conversing with a youngster with little legal understanding. In law, you declare "with the authority of" followed by the legislation or case that supports your argument. In the last step of Apply to Facts, you apply the case's logic to your factual circumstance. Your advice will sound and seem professional and organised. The reason it is dubbed the "Fact Legislation Sandwich" is because the advice has two layers of facts that surround the principle and law.
THE STYLE IN WHICH THE BOOK IS WRITTEN
This book is intended to offer students a thorough understanding of the most significant cases in their field of study. It is constructed so as to ease the Fact Law Sandwich technique. I include the overall concept, the name of the case with a complete citation, the facts, the Ratio (something professors insist you must always use), and the application, i.e. how the case should be applied. No other publication makes this knowledge so readily available. I hope you find it useful.
